Terms and Conditions

The short version
Use the service for legal purposes. Pay your bills. Don't be a jerk. We'll do our best to keep things running. Neither of us will sue each other over minor grievances. Standard business relationship stuff.
Agreement
By using serverless.au, you agree to these terms. If you don't agree, don't use the service. Pretty simple.
serverless.au is operated by The IT Dept Pty Ltd (ABN 12 665 405 505). These terms are governed by Australian law.
The service
We provide a platform for deploying JavaScript applications to Australian edge servers. You connect your GitHub repository, we build and deploy your code.
We'll make reasonable efforts to keep the service available and performant, but we don't guarantee 100% uptime. Things break sometimes. We'll fix them as quickly as we can.
Your account
You need a GitHub account to use serverless.au. You're responsible for keeping your account secure. If someone gains access to your account and deploys something nasty, that's on you.
One account per person or organisation. Don't share accounts. Don't create multiple accounts to circumvent limits.
Acceptable use
Use the service for legitimate purposes. Don't use it for:
- Anything illegal under Australian law
- Distributing malware or phishing pages
- Hosting content that infringes copyright
- Cryptocurrency mining
- Sending spam or running botnets
- DDoS attacks or other malicious traffic
- Storing or distributing illegal content
We reserve the right to suspend or terminate accounts that violate these rules. We won't refund you if we do.
Your code
You own your code. We don't claim any rights to it. We access your repositories solely to build and deploy your applications.
You're responsible for ensuring your code doesn't violate anyone's intellectual property rights. If you deploy someone else's copyrighted material without permission, that's your problem.
Payment
The service costs $10 AUD per month per active project, excluding GST. GST will be added for Australian customers.
Payment is processed by Stripe. We don't store your card details. Subscriptions renew automatically each month unless cancelled.
We can change our pricing with 30 days notice. If you don't like the new prices, cancel before the next billing cycle.
We don't offer refunds for partial months. If you cancel mid-month, you keep access until the end of the billing period.
Data security
We take security seriously. Your code and data are encrypted at rest and in transit. We use industry-standard security practices.
We perform regular backups. However, you should maintain your own backups of critical data. We're not responsible for data loss due to factors outside our control.

Availability
We aim for high availability but don't guarantee specific uptime percentages. Scheduled maintenance will be announced in advance when possible.
We may occasionally need to suspend the service for emergency maintenance or security issues. We'll try to minimise disruption.
Limitation of liability
To the maximum extent permitted by Australian law:
- We provide the service "as is" without warranties of any kind
- We're not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the fees you've paid us in the past 12 months
This doesn't affect your rights under Australian Consumer Law. If you're a consumer, you have statutory guarantees that can't be excluded.
Indemnification
You agree to indemnify us against claims arising from:
- Your use of the service
- Content you deploy
- Violation of these terms
- Infringement of third-party rights
Basically, if you do something dumb and we get sued, you're covering the legal bills.
Termination
You can cancel your account anytime from your account settings. We can suspend or terminate accounts that violate these terms.
When your account is terminated, we'll delete your data within 30 days, except for payment records we're legally required to retain.
Some sections of these terms survive termination, including limitation of liability and indemnification.
Changes to terms
We may update these terms occasionally. Significant changes will be communicated via email or through the service.
Continued use of the service after changes take effect constitutes acceptance of the new terms.
Disputes
If we have a disagreement, let's try to sort it out like adults first. Email us and we'll work through it.
If that doesn't work, disputes will be resolved under the laws of New South Wales, Australia. Both parties submit to the jurisdiction of courts in NSW.
General
If any part of these terms is found unenforceable, the rest still applies. Our failure to enforce a right doesn't waive that right.
These terms represent the entire agreement between you and us regarding the service. Previous agreements or representations are superseded.
